Membership Terms, Conditions, and Liability Waiver/Release

Effective Date: 4/8/2026

1. AGREEMENT TO TERMS

By enrolling as a member, booking a hunt, or participating in any activity with The Ultimate Hunting Experience LLC (“Company,” “we,” “our,” or “us”), you (“Member,” “Participant,” or “you”) agree to be bound by these Terms and Conditions, including the Liability Waiver and Release set forth below.

2. MEMBERSHIP & AUTO-RENEWAL

If you enroll in a membership:

  • Your membership may automatically renew based on your selected term (e.g., annual) unless canceled prior to the renewal date (“Renewal Date”).
  • You authorize us to charge your payment method on file at the then-current membership rate.
  • You may cancel at any time prior to renewal.

Refund Policy:

  • Membership fees are non-refundable, but can be cancelled at anytime.

3. PAYMENT AUTHORIZATION

By providing payment information, you:

  • Authorize recurring charges for membership fees and any booked services
  • Confirm you are authorized to use the payment method
  • Agree to update your payment information if it changes

We may retry failed payments and suspend or terminate services for non-payment.

4. HUNTING ACTIVITIES & ASSUMPTION OF RISK

You understand that hunting, outdoor recreation, and related activities involve inherent and significant risks, including but not limited to:

  • Firearm or weapon use
  • Wildlife encounters (including dangerous animals)
  • Uneven terrain, falls, or environmental hazards
  • Weather-related risks
  • Equipment failure
  • Remote locations with limited medical access

YOU EXPRESSLY ACKNOWLEDGE AND VOLUNTARILY ASSUME ALL RISKS, whether known or unknown, associated with participation.

5. LIABILITY WAIVER & RELEASE

To the fullest extent permitted by law, you hereby:

  • Release, waive, and discharge The Ultimate Hunting Experience LLC, its owners, officers, employees, guides, contractors, landowners, and affiliates from any and all liability for injury, death, loss, or damage arising from participation in any activities
  • Agree not to sue the Company for any claims arising from negligence (except where prohibited by law)
  • Accept full responsibility for any personal injury, property damage, or loss

This release applies to all claims, including those resulting from:

  • Negligence
  • Equipment issues
  • Acts of third parties
  • Environmental or natural conditions

6. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless The Ultimate Hunting Experience LLC from any claims, damages, or expenses (including attorney’s fees) arising from:

  • Your participation in activities
  • Your violation of laws or regulations
  • Your breach of these Terms

7. MEDICAL AUTHORIZATION

You authorize the Company to obtain emergency medical treatment on your behalf if necessary.

You understand that:

  • You are responsible for all medical costs incurred
  • The Company does not provide medical insurance

8. SAFETY & COMPLIANCE

You agree to:

  • Follow all safety instructions and guide directions
  • Comply with all federal, state, and local hunting laws
  • Use firearms and equipment responsibly
  • Not participate under the influence of drugs or alcohol

We reserve the right to remove any participant who violates safety rules without refund.

9. TEXT/SMS MESSAGING TERMS

By providing your phone number, you agree to receive SMS/MMS messages, including:

  • Booking confirmations
  • Membership updates
  • Promotions
  • Message frequency may vary
  • Message & data rates may apply

10. EMAIL COMMUNICATIONS

You consent to receive email communications related to:

  • Membership
  • Bookings
  • Promotions

You may unsubscribe from marketing emails at any time.

11. LIMITATION OF LIABILITY

To the fullest extent permitted by law:

  • The Company shall not be liable for indirect, incidental, or consequential damages

12. DISPUTE RESOLUTION & ARBITRATION

Any disputes arising from this Agreement shall be resolved through binding arbitration.

  • No class actions permitted
  • Claims must be brought individually
  • Arbitration shall take place in the state where the Company operates

Exceptions include:

  • Small claims court
  • Injunctive relief
  • Intellectual property claims

13. GOVERNING LAW

This Agreement shall be governed by the laws of the State of Texas, without regard to conflict of law principles.

14. SEVERABILITY

If any provision of this Agreement is found unenforceable, the remaining provisions shall remain in full force and effect.

15. CHANGES TO TERMS

We reserve the right to update these Terms at any time. Continued participation constitutes acceptance of any changes.

16. ACKNOWLEDGMENT & SIGNATURE

By participating in any activity or purchasing a membership, you acknowledge that:

  • You have read and understand this Agreement
  • You voluntarily agree to all terms
  • You understand you are waiving certain legal rights, including the right to sue
